Planehook...preparing for the 2009 Tax Man

Something I took away from yesterday's meeting was the concern over business aviation remaining a cost-effective tool.  I didn't want to bring this up then--it would have appeared a little too self-serving--but there is a way to reduce the tax basis for those flying on business aircraft.  The specifics are in IRS Rule 1.132-5 (here's the link)  http://www.irs.gov/businesses/corporations/article/0,,id=134943,00.html .
 
Scroll down to the section titled Security-Related Transportation.  This fringe benefit tax rule provides a means to reduce the tax basis for the executives whose use of business aviation is considered a taxable benefit.  The gotcha in this is to have an independent security study performed because an internal company security study won't withstand a tax audit.  But ultimately, if the primary users of your flight departments are deriving benefit at a lower tax basis, they'll be less inclined to reduce pilots, technicians and aircraft.
 
I see having SAABAA members know about this tax rule as a form of job security.  If you have any questions, please don't hesitate to contact me because I think this next tax year is going to be pretty difficult on all of us.
